AN ACT TO AMEND TITLE 7, DELAWARE CODE RELATING TO THE POWERS AND DUTIES OF THE DEPARTMENT OF NATURAL RESOURCES AND ENVIRONMENTAL CONTROL IN THE ESTABLISHMENT OF ENTRANCE FEES TO STATE PARKS AND RECREATION AREAS.

Be it enacted by the General Assembly of the State of Delaware:

Section 1. Amend Section 4701(a) (5), Title 7, of the Delaware Code by striking the second and third sentences thereof in their entirety and inserting in lieu thereof the following:

"The Department of Natural Resources and Environmental Control, Division of Parks and Recreation shall, in addition, charge the operator of a Delaware registered motor vehicle an entrance fee to State parks and recreation areas of not less than $1.00 per day and the operator of an out-of-state registered motor vehicle a fee of not less than $2.00 per day. The operator of a Delaware registered motor vehicle carrying more than ten (10) people shall be charged an entrance fee of not less than $2.00 per day and the operator of an out-of-state registered motor vehicle carrying more than ten (10) people a fee of not less than $4.00 per day. The operator of a Delaware registered motor vehicle carrying more than thirty (30) people shall be charged an entrance fee of not less than $5.00 per day and the operator of an out-of-state registered motor vehicle carrying more than thirty (30) people a fee of not less than $10.00 per day. Delaware residents with a valid Delaware registered motor vehicle may pay an annual fee of not less than $5.00 for each such registered motor vehicle which shall permit the vehicle entrance to any state park or recreation area during the calendar year for which the fee was paid. Out-of-state residents with a valid out-of-state registered motor vehicle may pay an annual fee of not less than $15.00 for each such registered motor vehicle which shall permit the vehicle entrance to any state park or recreation area during the calendar year for which the fee was paid. An owner of motor vehicle capable of carrying more than ten (10) people, regardless of Delaware or out-of-state registration, shall not be entitled to an annual permit.

The Secretary of the Department of Natural Resources and Environmental Control shall establish the periods and areas on which park user fees are charged."
