AN ACT TO CORRECT CERTAIN ADMINISTRATIVE ERRORS RESULTING IN LOSS OF PAY TO CERTAIN PREVIOUS EMPLOYEES OF THE DEPARTMENT OF PUBLIC SAFETY AND PROVIDING FOR THE PAYMENT OF LOST PAY.

WHEREAS, three previous employees of the Department of Public Safety, through administrative errors, have suffered loss of duly earned pay; and

WHEREAS, said errors were not the fault of the employees; and

WHEREAS, the errors were discovered during the annual audit for fiscal year 1973; and

WHEREAS, it was too late to initiate corrective action through the 127th General Assembly, second session; and

WHEREAS, the Department of Public Safety has sufficient funds available created through salary savings during fiscal year 1975 to make restitution; and

WHEREAS, the State of Delaware through the Department of Public Safety does in fact owe certain salary amounts to certain employees.

NOW, THEREFORE:

Be it enacted by the General Assembly of the State of Delaware:

Section 1. The sum of two-hundred forty-eight dollars and fifty cents ($248.50) be paid to Catherine Hart from salary savings accumulated during fiscal year 1975 by the Motor Fuel Tax Division of the Department of Public Safety. The aforementioned salary is due as a result of an oversight in not granting an annual increment for satisfactory performance during the period July 1, 1971 through June 30, 1972.

Section 2. The Office of Pensions and Investments is hereby directed to review, recalculate, and adjust the pension of Catherine Hart and to pay any retroactive amounts due as a result of the recalculation.

Section 3. The Department of Public Safety is hereby authorized to transfer the sum of one hundred thirty-nine dollars and ninety-one cents ($139.91) from the Motor Vehicle Division to the State Office of Personnel for the payment of accrued annual leave not paid and due to Drema Sue Sheltzler. The aforementioned individual being a former employee of the Motor Vehicle Division who resigned and left State employment and through an administrative error was not paid for 10.25 accrued days of annual leave as required by the Rules of the Merit System.

Section 4. The sum of one thousand five hundred thirty-two dollars and eighty-five cents ($1,532.85) be paid to Barnard C. Muir from salary savings accumulated during fiscal year 1975 by the Division of the Boiler Safety of the Department of Public Safety. Said employee applied for disability pension and was not afforded the rights to which he was entitled under the provisions of Chapter 55, §5524, Title 29, Delaware Code.
