AS AMENDMENT BY SENATE

AMENDMENT NO. 1

AN ACT TO AMEND CHAPTER 33, TITLE 19, DELAWARE CODE, RELATING TO UNEMPLOYMENT COMPENSATION.

Be it enacted by the General Assembly of the State of Delaware:

Section 1. Section 3350 (1), Title 19, Delaware Code, is amended by adding the following at the end thereof:

Except that wages paid to an employee during his base period for part-time employment by an employer who continues to give the employee employment to the same extent while he is receiving benefits as he did during his base period shall not be determined to be employee's benefit wages. The employer shall establish the continuation of work to the satisfaction of the Department by submitting such information as the Department may require within four business days after the notification or mailing of notice by the Department that the employee has first filed a claim for benefits.

Section 2. This act shall take effect July 1, 1972, and no charges to employers shall be affected by this act until that date.
