AN ACT TO PROVIDE A SUPPLEMENTARY APPROPRIATION TO THE DEPARTMENT OF HEALTH AND SOCIAL SERVICES TO BE USED FOR SALARY REIMBURSEMENT FOR EMPLOYEES OF THE DIVISION OF JUVENILLE CORRECTIONS.

WHEREAS, twelve employees of the Division of Juvenile Corrections were not paid a 5% overtime differential for the period April, 1970, through February 28, 1971; and

WHEREAS, these employees were entitled to be paid a 5% overtime differential for the period indicated above, in accordance with Merit System Rule 5.0320 (deleted March 1, 1971); and

WHEREAS, the Office of the Budget has determined that such reimbursement can only be made by means of a supplementary appropriation because such claims revert to Fiscal Years 1970 and 1971.

NOW, THEREFORE:

Be it enacted by the General Assembly of the State of Delaware:

Section 1. The sum of two thousand seven hundred and seventy-nine dollars and seventy-nine cents ($2,779.97) is hereby appropriated to the Department of Health and Social Services, which money shall be paid to the following employees of the Division of Juvenile Corrections, for wages due them for the period April, 1970, through February 28, 1971, for which they have not yet received payment:

Section 2. This Act is a supplementary appropriation act and funds hereby shall be paid from the General Fund of the State Treasury from moneys not otherwise appropriated.

Section 3. The funds herein appropriated shall be expended only in the manner set forth in Section 1, and any funds appropriated but unexpended by June 30, 1972, shall thereupon revert to the General Fund of the State Treasury.
