CHAPTER 406

AN ACT TO AMEND SECTION 2942, TITLE 21, DELAWARE CODE, RELATING TO SUSPENSION OF LICENSE FOR NON-PAYMENT OF JUDGEMENTS BY ALLOWING AN OCCUPATIONAL LICENSE UNDER CERTAIN CONDITIONS.

Be it enacted by the General Assembly of the State of Delaware:

Section 1. Section 2942, Title 21, Delaware Code, is amended by adding a new subsection after subsection (c) to be known as subsection (d) to read as follows:

(d) In the event that a person has had his license and registration suspended for non-payment of a judgment under this section, the Department after the lapse of 1 year from the entry of the judgment may issue an occupational license during the period of suspension pursuant to section 2733 of this title, provided that no prior occupational license has been issued pursuant to this section and provided further that such persons shall have produced proof of viability insurance coverage or other evidence of financial responsibility in an amount and of such character as shall be satisfactory to the Commissioner.
