CHAPTER 90

AN ACT TO AMEND CHAPTER 9, TITLE 10, DELAWARE CODE, BY ENLARGING THE JURISDICTION OF THE FAMILY COURT IN THE DISPOSITION OF CERTAIN CHILDREN.

Be it enacted by the General Assembly of the State of Delaware (two-thirds of all Members elected to each Branch concurring therein):

Section 1. Title 10, Delaware Code, is amended by adding a new paragraph (9) following paragraph (8) of § 984 (a) of Chapter 9 thereof to read:

(9) Commit a child who has attained his sixteenth birthday and who is alleged to have thereafter committed a violation of the penal law and who, in the judgment of the Court, needs rehabilitative service in a secure setting, to the joint custody of the State Board of Corrections to provide such secure setting, and to the Youth Services Commission to provide such rehabilitative service, such secure holding and such rehabilitative service to continue so long as they are both needed by the child. The joint custody of such child may be terminated by the Court upon the petition of either of the joint custodians or on its own motion.
