CHAPTER 108

PROVIDING FOR TRANSFER OF PROPERTY OF MIDDLETOWN ACADEMY TO ST. GEORGES HUNDRED HISTORICAL SOCIETY

AN ACT TO TRANSFER PROPERTY, ASSETS AND CLAIMS DERIVED BY THE STATE OF DELAWARE FROM THE TRUSTEES OF THE MIDDLETOWN ACADEMY TO THE ST. GEORGES HUNDRED HISTORICAL SOCIETY.

Be it enacted by the Senate and House of Representatives of the State of Delaware in General Assembly met:

Section 1. That all of the property, assets, claims, demands or cause or causes of action of any nature whatsoever, which the State of Delaware has received, now has, or might receive through or by virtue of, or in connection with the dissolution of The Trustees Of The Middletown Academy, a charitable corporation of the State of Delaware, or through said corporation, or any court proceedings in connection therewith, be and the same are hereby set over, transferred and assigned to the St. Georges Hundred Historical Society, a charitable corporation of the State of Delaware, its successors and assigns. The said St. Georges Hundred Historical Society is hereby appointed its true and lawful attorney irrevocable, with full power of substitution and revocation for the State of Delaware in its name or otherwise, but for the full use and benefit of the St. Georges Hundred Historical Society at its own cost and expense to ask, demand, sue for, collect, receive, appoint and to take any other action of whatsoever nature with respect to the said property, assets, claims, demands or cause or causes of action of any nature whatsoever, or any part thereof.

Section 2. The Governor and Secretary of the State of Delaware are hereby authorized and directed to execute in favor of the St. Georges Hundred Historical Society, a corporation of the State of Delaware, any and all documents necessary to set over, assign and transfer the property and claims as set forth in Section 1 of this Act.
