CHAPTER 337 - HOUSE JOINT RESOLUTION

AUTHORIZING THE STATE TREASURER TO REDEEM AN OUT-DATED CHECK ISSUED BY FAGAN H. SIMONTON, FORMER TREASURER OF DELAWARE, ON DECEMBER 8, 1939 AND TO ISSUE A NEW CHECK IN LIEU THEREOF.

WHEREAS, Fagan H. Simonton, on December 8, 1939, as State Treasurer issued Check Number 0 44501 for the sum of Seventeen Dollars and Fifteen cents ($17.15) in payment of a certain payroll account payable to the order of Green Mumford, for the period ending December 2, 1939, payable at the Farmers Bank, Dover, Delaware, and delivered the said check to the said Green Mumford promptly thereafter; and

WHEREAS, the said Green Mumford mislaid the said check and later on found it and endorsed it in blank. Bessie J. Carey, the holder of said check thereupon also endorsed said check and presented it for payment at the First National Bank of Philadelphia, Pennsylvania on January 20, 1945; and

WHEREAS, the fund set up hi the biennial budget, out of which the said check would have been paid if it had been presented within two years of its said date, has long since reverted to the General Fund of the State Treasury, according to law; and, therefore, the said check was not honored for payment when presented to the Farmers Bank of Dover but was returned unpaid and marked "Stale Date";

NOW, THEREFORE, Be it resolved by the House of Representatives, the Senate concurring therein:

Section 1. That the present State Treasurer, on presentation of the said outdated check for cancellation, be and he is hereby authorized and directed to pay to said Bessie J. Carey, the holder of said check, the sum of Seventeen Dollars and Fifteen cents ($17.15), being the amount of said outdated check.

Section 2. That this Joint Resolution shall be taken and deemed to be in the nature of a Supplementary Appropriation Act, and the money hereby authorized to be paid shall be paid out of the General Fund of the State Treasury, not otherwise appropriated.
