CHAPTER 336 - HOUSE JOINT RESOLUTION

AUTHORIZING THE STATE TREASURER TO REDEEM AN OUT-DATED CHECK AND TO ISSUE A NEW CHECK IN LIEU THEREOF.

WHEREAS, Fagan H. Simonton, on a certain day in 1939, the exact date being unknown, as State Treasurer, issued Check Number A 2919 for the sum of Thirty Dollars and Fifty cents ($30.50) in payment of certain repairs to the Ferris Industrial School, payable to the order of Grady's, Eighth and Orange Streets, Wilmington, Delaware, payable at the Farmers Bank, Dover, Delaware, and delivered the said check to the said Grady's promptly thereafter; and

WHEREAS, the said Grady mislaid the said check and did not present it for payment until May 25, 1942; and

WHEREAS, the fund set up in the biennial budget, out of which the said check would have been paid if it had been presented within two years of its said date, has long since reverted to the General Fund of the State Treasury, according to law; now, therefore,

BE IT RESOLVED by the House of Representatives, the Senate concurring therein:

Section 1. That the present State Treasurer, on presentation of the said outdated check for cancellation, be and he is hereby authorized and directed to pay to said Grady's, Eighth and Orange Streets, Wilmington, Delaware, the sum of Thirty Dollars and Fifty cents ($30.50), being the amount of said outdated check.

Section 2. That this Joint Resolution shall be taken and deemed to be in the nature of a Supplementary Appropriation Act, and the money hereby authorized to be paid shall be paid out of the General Fund of the State Treasury.
