CHAPTER 283 - MOTOR VEHICLES - APPLICATION OF MINOR FOR OPERATOR'S LICENSE

AN ACT TO AMEND CHAPTER 165 OF THE REVISED CODE OF DELAWARE, 1935, AS AMENDED, RELATING TO MOTOR VEHICLES, BY PROVIDING FOR APPLICATIONS OF MINORS FOR OPERATOR'S LICENSE; PROVIDING EXPIRATION PERIOD FOR ANNUAL LICENSE; PROVIDING PERMITS FOR EXCESSIVE SIZE AND WEIGHT AND REGISTRATION OF SUCH VEHICLES.

Be it enacted by the Senate and House of Representatives of the State of Delaware in General Assembly met:

Section 1. That Chapter 165 of the Revised Code of Delaware, 1935, as amended, be and the same hereby is amended by striking out and repealing all of 5596 Sec. 58 thereof and by inserting in lieu thereof the following:

5596 Sec. 58. Application of Minor:--The Department shall not grant the application of any minor under the age of 18 years for an operator's license, unless such application is signed by the father of the applicant, if the father is living and is within the territorial limits of the several States of the United States and has custody of the applicant, otherwise by the mother or guardian having the custody of such minor, or in the event a minor under the age of 18 years has no father, or his father is not in the United States of America, and has no mother or guardian, then an operator's license shall not be granted to such minor unless his application therefor is signed by his employer.

Section 2. That Chapter 165 of the Revised Code of Delaware, 1935, as amended, be and the same is hereby further amended by repealing and striking out all of 5603 Sec. 65 of said Chapter and by inserting in lieu thereof the following:

5603 Sec. 65. Expiration of Annual License:--Every annual operator's or chauffeur's license (excepting permanent operator's or chauffeur's licenses) issued under this Chapter shall expire on May 31 of each year and shall be renewed annually upon application and payment of the fees required by law, such renewal to take effect on the first day of June in each year; provided, that the Department in its discretion, may waive the examination of any such applicant previously licensed under this Chapter.

Section 3. That Chapter 165 of the Revised Code of Delaware, 1935, as amended, be and the same hereby is amended by repealing and striking out, all of 5657 Sec. 119 thereof and by inserting in lieu thereof the following:

5657, Sec. 119. Permits for Excessive Size and Weight:--The State Highway Department, and local authorities in their respective jurisdiction, may, in their discretion, upon application in writing and good cause being shown therefor, issue a special permit in writing authorizing the applicant to operate or move a vehicle of a size or weight exceeding the maximum specified in this Chapter, upon any highway under the jurisdiction of and for the maintenance of which the body granting the permit is responsible. Every such permit shall be issued for a single trip and may designate the route to be traversed and contain any other restrictions or conditions deemed necessary by the body granting such permit. Every such permit shall be carried in the vehicle to which it refers and shall be open to inspection by any peace officer and it shall be a misdemeanor for any person to violate any of the terms or conditions of such special permit, and shall be punished as provided in Section 142 of this Chapter.

Such vehicle or trailer shall be registered with the Department as provided by Sections 8 and 14 of this Chapter, upon the payment of the fee provided by Section 26 of this Chapter. The T registration plates shall be issued by the Department for all such vehicles or trailers.
