CHAPTER 212 - OYSTERS - DIRECTING STATE HIGHWAY COMMISSION TO MAKE A SURVEY OF REHOBOTH BAY, INDIAN RIVER AND BAY
AN ACT TO AMEND CHAPTER 151, VOLUME 44, LAWS OF DELAWARE, BY AUTHORIZING AND DIRECTING THE STATE HIGHWAY DEPARTMENT TO MAKE A SURVEY OR SURVEYS OF REHOBOTH BAY, INDIAN RIVER, AND INDIAN RIVER BAY, FOR THE USE AND BENEFIT OF THE DELAWARE COMMISSION OF SHELL FISHERIES.
WHEREAS under the provisions of Chapter 151, Volume 44, Laws of Delaware, and the rules and regulations adopted by "The Delaware Commission of Shell Fisheries" under the authority of said Chapter, certain areas of Rehoboth Bay, Indian River, and Indian River Bay have been leased to individuals for the planting of shellfish, and
WHEREAS it is desirable to Have surveys made of the areas so leased and to know the extent of the waters aforesaid for the guidance of the said Commission; NOW THEREFORE
Be it enacted by the Senate and House of Representatives of the State of Delaware in General Assembly met:
Section 1. That Chapter 151, Volume 44, Laws of Delaware, be further amended by adding after Section 12 of said Chapter 151 a new section to be entitled Section 12A., as follows:
Section 12A. The State Highway Department of the State of Delaware, is-hereby authorized and directed to make a survey of the waters of Rehoboth Bay, Indian River and Indian River Bay, as to the total areas of such bodies of water, and a survey of the location and extent of all areas that have been leased for the planting of shellfish.
Section 2. The State Highway Department is hereby authorized and directed to make such survey or surveys as soon as practicable, and to furnish the Delaware Commission of Shell Fisheries the results of the survey or surveys made under the provisions of this Act.
Section 3. That in addition to any other moneys appropriated to the State Highway Department, there is hereby appropriated to the said Department, the further sum of Two Thousand Dollars ($2,000.00) for the purpose of defraying the cost of making the survey herein provided. In the event that any part of said sum shall remain unexpended on June 30, 1946, the said part so unexpended shall revert to the General Fund of the State.
Section 4. This Act shall be known as a Supplementary Appropriation Act and the moneys hereby appropriated shall be paid out of the General Fund of the State Treasury from funds not otherwise provided.
