CHAPTER 106 - STATE BOARD OF EDUCATION - PENSION FUND FOR DISABLED SCHOOL TEACHERS

AN ACT APPROPRIATING CERTAIN MONIES TO PROVIDE A PENSION FUND FOR RETIRED AND DISABLED PUBLIC SCHOOL TEACHERS OF DELAWARE.

Be it enacted by the Senate and House of Representatives of the State of Delaware in General Assembly met:

Section 1. That there is hereby appropriated for each of the fiscal years in the biennial period, beginning July 1, 1945 and ending June 30, 1947 the sum of Twenty-five Thousand Dollar's ($25,000.00) to create a fund for the purpose of paying pensions or allowances to retired and disabled teachers who have taught in public schools within the State of Delaware.

Section 2. The fund so created shall be used and expended for the benefit of:

(a) Teachers, now inactive in their profession, who have taught in the public schools of the State of Delaware for twenty-five (25) years or more, and are no longer capable of teaching; such former teachers upon making application for such pensions or allowances to the State Board of Education shall be entitled to receive the sum of Thirty Dollars ($30.00) per month;

(b) Teachers who, because of failing or lost eyesight, loss of limb or other physical disability, have been required to abandon the teaching profession and by reason of such disability, are incapable of securing employment producing a living wage, and who have taught as many as three school years in the State of Delaware, upon making application for such pensions or allowances to the State Board of Education shall be entitled to receive the sum of Thirty Dollars ($30.00) per month.

(c) Section 3. The State Board of Education is hereby designated as the Agency to make investigations in order to determine the eligibility of the applicants or persons entitled to receive benefits under the provisions of this Act. In the event that the State Board of Education should be unable to determine whether or not teachers are entitled to the benefits of this Act under Section 2. (b) hereof, the said State Board of Education shall certify the names of such teachers to the Superintendent of the Delaware State Hospital for his examination and conclusions concerning the physical disability of such teachers and, in all such cases, the determination and decision of the said Superintendent of the Delaware State Hospital shall be conclusive and final and binding upon the State Board of Education. The said Superintendent shall thereupon report his findings in writing to the State Board of Education.

Section 4. The State Treasurer is hereby authorized and directed to pay, monthly, to persons designated by the State Board of Education as being entitled to the benefits of this Act, upon and according to warrants drawn by the Secretary of the State Board of Education.

Section 5. All monies hereby appropriated and not expended during any fiscal year, shall revert to the General Fund of the State Treasury.

Section 6. This Act shall be known as a Supplementary Appropriation Act and the money hereby appropriated shall be paid out of the General Fund of the State Treasury not otherwise appropriated.
