CHAPTER 65 - APPROPRIATION - DELAWARE STATE GUARD

AN ACT APPROPRIATING MONEY FOR PAY OF THE OFFICERS AND MEN OF THE DELAWARE STATE GUARD DURING THEIR ANNUAL SUMMER ENCAMPMENTS.

Be it enacted by the Senate and House of Representatives of the State of Delaware in General Assembly met:

Section 1. That the sum of Ten Thousand Dollars ($10,000) is hereby appropriated out of the Treasury of the State of Delaware to The Adjutant General of Delaware for the fiscal year beginning July 1, 1945 and ending June 30, 1946, and a like sum of Ten Thousand Dollars ($10,000) for the fiscal year beginning July 1, 1946 and ending June 30, 1947, for the purpose of paying the officers and enlisted men of the Delaware State Guard during their annual summer encampment not to exceed eight days each year. The rate of pay per diem of each officer and enlisted man shall be at the rate prescribed for emergency service by Section 3, of Chapter 81, Laws of Delaware 1941, except that the pay of the members of the band shall be fixed at the flat rate of Five Dollars ($5) per diem and that of the band leader at Ten Dollars ($10) per diem.

Section 2. Pay rolls shall be prepared by the commanding officers of each company or detachment, and muster shall be conducted by The Adjutant General and the Property and Disbursing Officer in as nearly the same form and manner as that formerly used for Federal pay and muster by the Delaware National Guard. The commanding officer of each unit or detachment shall at the end of each pay roll make affidavit to the correctness of the pay roll and shall have each member of his unit or detachment sign in duplicate opposite his name on the pay roll. The original pay roll will be submitted by The Adjutant General to the State Auditor and State Treasurer with appropriate voucher requesting checks to be issued in the names of the men in amounts shown to be due.

Section 3. Any unused balance and not otherwise encumbered shall each year remain in and revert to the State Treasury.

Section 4. That this Act shall be known as a Supplementary Appropriation Act and the money hereby appropriated shall be paid out of the General Funds of the State Treasury, not otherwise appropriated.
