CHAPTER 49 - APPROPRIATION - WILLIAM KENNETH LAYFIELD CLAIM

AN ACT APPROPRIATING THE SUM OF SEVEN HUNDRED TWENTY DOLLARS TO THE DELAWARE COMMISSION FOR THE FEEBLE MINDED TO PAY THE CLAIM OF WILLIAM KENNETH LAYFIELD FOR DAMAGES TO HIS AUTOMOBILE.

WHEREAS, William Kenneth Layfield was on the Sixteenth day of October, A. D. 1944 the owner of a Chevrolet Tudor Sedan, Model 1941; and

WHEREAS, the said William Kenneth Layfield is now serving in the United States Army Air Force in England; and

WHEREAS, on the Sixteenth day of October, A. D. 1944, Russell Griffin White and Robert Ridgway, while under the care and jurisdiction of the Delaware Commission for the Feeble Minded at the State Institution known as Delaware Colony, near Stockley, Sussex County, Delaware, escaped therefrom; and

WHEREAS, the said Russell Griffin White and Robert Ridgway while they were absent without leave from said institution did steal, take and carry away the said Chevrolet Tudor Sedan, Model 1941, owned by William Kenneth Layfield, while the same was parked in front of the home of Orville Layfield, the father of William Kenneth Layfield, in Dagsboro Hundred, Sussex County and State of Delaware, and did have an accident causing great damage to the said automobile; and

WHEREAS, the said Chevrolet Tudor Sedan was rendered beyond repair and was good only for salvage; and

WHEREAS, the said William Kenneth Layfield has suffered great damages:

NOW, THEREFORE, Be it enacted by the Senate and House of Representatives of the State of Delaware in General Assembly met:

Section 1. That the sum of Seven Hundred Twenty Dollars ($720.00) is hereby appropriated to the Delaware Commission for the Feeble Minded from the monies in the State Treasury, not otherwise appropriated, to be used by the aforesaid Delaware Commission for the Feeble Minded to pay William Kenneth Lay-field for damages incurred by him as the result of his Chevrolet Tudor Sedan, Model 1941, being stolen and wrecked by the said Russell Griffin White and Robert Ridgway on October 16, 1944 while they were absent without leave from the State Institution known as Delaware Colony.

Section 2. The monies hereby appropriated shall be paid by the State Treasurer upon proper warrant or warrants signed by the Chairman of the Commission for the Feeble Minded and approved by the Auditor of Accounts.

Section 3. This act shall be known as a Supplemental Appropriation Act.
