CHAPTER 6 - STATE BOARD FOR VOCATIONAL EDUCATION

AN ACT TO AMEND CHAPTER 201, 42 LAWS OF DELAWARE, ENTITLED "AN ACT TO PROVIDE FOR THE VOCATIONAL REHABILITATION AND PLACEMENT OF PHYSICALLY DISABLED PERSONS, AND TO MAKE APPROPRIATIONS FOR THE SAME", BY REDEFINING THE TERM "DISABLED PERSON" AND INCREASING THE SCOPE OF SAID ACT.

Be it enacted by the Senate and House of Representatives of the State of Delaware in General Assembly met:

Section 1. That Chapter 201, Volume 42, Laws of Delaware, be and the same is hereby amended by striking out all of Section 1 thereof and by enacting and inserting in lieu thereof the following:

Section 1. That in order to provide for the vocational rehabilitation of disabled persons, there is hereby established, under the direction and control of the State Board for Vocational Education, a division for the vocational rehabilitation and placement in remunerative employment of persons whose capacity to earn a living is or has been destroyed or impaired.

Section 2. That Chapter 201, Volume 42, Laws of Delaware, be and the same is hereby amended by striking out all of Section 2 thereof and by enacting and inserting in lieu thereof the following:

Section 2. That for the purposes of this Act the term "disabled person" means any person who, by reason of a defect or infirmity, whether congenital or acquired by accident, injury, or disease, is, or may be expected to be, totally or partially incapacitated for remunerative occupation; the term "vocational rehabilitation" means the rendering of a disabled person fit to engage in a remunerative occupation.

To be eligible for rehabilitation a person must possess an employment disability. and must be susceptible of rehabilitation.

Section 3. That Chapter 201, Volume 42, Laws of Delaware, be and the same is hereby amended by striking out all of Section 6 thereof and by enacting and inserting in lieu thereof the following:

Section 6. The State of Delaware hereby accepts the provisions and benefits of the Act of Congress entitled "An Act to Provide for the Promotion of Vocational Rehabilitation of Persons Disabled in Industry or Otherwise and Their Return to Civil Employment", approved June 2, 1920, as amended; and designates the State Treasurer as custodian of all moneys received by the State from appropriations made by the Congress of the United States for vocational rehabilitation of persons disabled in industry or otherwise, and authorizes the State Treasurer to make disbursements therefrom upon the order of the State Board for Vocational Education; and empowers and directs the State Board for Vocational Education to cooperate with the Office of United States Vocational Rehabilitation, Federal Security Agency, or other Federal agency authorized by Congress, in carrying out the provisions of the national Vocational Rehabilitation Act and amendments thereto.

Section 4. This Act shall become effective immediately upon the approval thereof.
